1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the LogoCraft Design AI Generator mobile application and website ("Service") operated by LogoCraft HK Limited ("Company", "we", "us", or "our"), a company incorporated in Hong Kong SAR, with its principal place of business at 23/F, Tower One, Lippo Centre, 89 Queensway, Admiralty, Hong Kong.
By accessing or using our Service, you confirm that you are at least 13 years old and have the legal capacity to enter into a binding agreement.
2. Description of Service
LogoCraft is a mobile application that provides:
- AI-powered logo generation tools
- Access to a library of 2,000+ logo templates and 6,000+ design resources
- Logo editing, customization, and export functionality
- Cloud auto-save and cross-device synchronization
- Free and premium (Pro) subscription tiers
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Payments
4.1 Free Tier: LogoCraft offers a free tier with limited functionality at no cost.
4.2 Pro Subscriptions: Premium features are available through monthly ($7.99/month) or annual ($59.99/year) subscriptions, managed through Google Play.
4.3 Billing: All payments are processed by Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
4.4 Refunds: Refund requests are governed by Google Play's refund policy. We do not offer direct refunds outside of the platform's standard process.
4.5 Price Changes: We reserve the right to modify pricing with 30 days' advance notice.
5. Intellectual Property
5.1 Our Content: All templates, design assets, icons, fonts, software, and other content provided by LogoCraft are owned by or licensed to us and are protected by copyright and intellectual property laws.
5.2 Your Logos: You retain full ownership of logos you create using our Service. By creating logos, you grant us a limited, non-exclusive license to display your designs for promotional purposes (e.g., showcasing in app store listings), unless you opt out by contacting us.
5.3 License to Use: We grant you a personal, non-transferable, non-exclusive, revocable license to use the Service for its intended purpose.
6. Acceptable Use
You agree not to use the Service to:
- Create logos that infringe on third-party trademarks or copyrights
- Design content that is obscene, defamatory, hateful, or illegal
- Reverse-engineer, decompile, or attempt to extract source code
- Circumvent any security features or access restrictions
- Use automated bots or scrapers to access content
- Resell or sublicense access to the Service
- Engage in any activity that disrupts or harms the Service or other users
7. AI-Generated Content
LogoCraft uses artificial intelligence to generate logo suggestions and design recommendations. You acknowledge that:
- AI-generated content may occasionally produce similar results for different users
- We do not guarantee uniqueness of AI-generated designs
- You are responsible for verifying that your final logo does not infringe on existing trademarks before commercial use
- We recommend conducting a trademark search before registering or commercially deploying any logo
8. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by applicable law:
- We disclaim all warranties, express or implied, including fitness for a particular purpose
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for third-party services, including Google Play
9. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination:
- Your license to use the Service ceases immediately
- You lose access to your designs stored in the cloud (export before terminating)
- Accrued rights and obligations that survive termination remain in effect
10. Governing Law and Disputes
These Terms are governed by the laws of Hong Kong SAR. Any disputes arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Hong Kong SAR.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
